First of all understand the system of POLICE COMMISSIONARY

To understand the system of Commissioner we compare the dual command system and commissionerate system

In Dual command system there is SP and ASP and other posts.

DM and SP share the power and liability in dual command system .Dual command system It was very useful in old and traditional system and it is generally useful in normal cities which have lesser population and in the city where lesser crime ratio.

Power of DM in dual command system:- In dual command system DM have power to issue licence and search warrants and other warrants and also DM have magisterial power.

This was arise from British system the Britishers made this system to ensure delegation of power because in this system the powers vested in two lobby first is police and second is executive.

What is the need of Commissionarte system – To maintain proper law and order.

Actually the new system will not only help in solving the problem but also it is useful in prevention of criminal activities and other anti socialist activities

When this system is applied – Where the population exceeds 10 Lacs. 

History– In INDIA , Before Independence  this system was applicable.

Present Scenerio- 72 cities of India have implemented COMMISSIONARATE system.

Changes after implementation of Police COMMISSIONARATE system

  1. One head office is to be made  and a senior IPS officer  is appointed as POLICE COMMISSIONER.
  2. In every zone one DCP is deployed. Who will be responsible for the maintenance of  law and order of the zone.
  3. One ASP is deployed For every 2 to 4 police station. And he will be responsible for those police station.

BENEFITS

  1. Establishment of new police courts for the cases registered under section 151 and section 107/116 of crpc.

Effects

  1. All the powers will delegate to commissioner from District magistrate as per crpc.
  2. No permission is required in cases of rioting under section 146.
  3. Instant action to be taken in any proceeding.
  4. All the powers of IAS will vest in Commissioner.
  5. The power to impose curfew under section 144 will vest in COMMISSIONER

The police commissioner system in MP

Two cities cover by this system are Indore and Bhopal

The Madhya Pradesh government has implemented the police commissionerate system in the Bhopal and Indore for the effective implementation of law and order in the two cities. A notification in this regard was issued at 09/12/2021

The police commissioner system covers 36 police stations in Indore and 38 in Bhopal.

Under this new system, in contrary to the previous system, the police commissioner will not have to report to the district magistrate and the judicial and executive powers in crime and law and order areas will be transferred to the police.

WHY IN INDORE AND BHOPAL ONLY ?

The system is necessary the system is necessary phone not only physical offence but also for the cyber crime in Bhopal and Indore. There are many offences like lottery, online Blacklist, blackmailing, human trafficking etc and to prevent cyber crime as well as physical crime such system is necessary.
